The Constitutional Court has ruled in favour of the Department of Trade & Industry and the North West Gambling Board (the Board) and dismissed the Casino Association South Africa (CASA) appeal in the allocation of the 5th Casino License to the North West province. The Casino Association of South Africa (CASA) had argued in court papers that the allocation of the fifth casino license will result in the proliferation of the gambling industry. This according to CASA will have far reaching ramifications for the industry’s economic prospects.
The department of Trade & Industry awarded the province the fifth casino license in June 2016. This emanating from the cross-boundary transfer of Morula Sun from the North West province to Gauteng. The ruling gave impetus to the economic trajectory of the province thus creating opportunities for the marginalised and downtrodden citizens of the North West.
While CASA argued that the allocation of the fifth casino license was an ill-conceived idea due to the current economic slump, the Board believes that it cannot be sufficient reason to deny the North West a license as we are in need of investment to turn the tide on the struggling economy.
Currently the Board is in the process of conducting a feasibility study which began in the third quarter of 2021/22 Financial year with the intention of possible location of the Casino. The subsequent completion of the project around the third quarter of 2023/2024 Financial year will have spill-over effects in many industries particularly in the tourism sector and retail industry.
